Grays Fined for Misleading Sales

Sydney, Feb 26: The Australian Competition and Consumer Commission (ACCC) has launched legal action against Grays eCommerce Group Limited, a leading online auction company in Australia, for providing false or misleading information about cars sold on its platform.
The accusations cover a range of inaccuracies in car listings, including incorrect make, model, features, and undisclosed defects, affecting transactions between July 2020 and June 2022.
Grays has acknowledged its misconduct, agreeing to a proposed $10 million fine for violating Australian Consumer Law.
The misleading practices led to at least 750 consumers purchasing vehicles under false pretenses, potentially resulting in overpayments or purchases they would have otherwise avoided.

The ACCC highlighted cases where cars were sold with inaccurate manufacturing years, transmission types, non-existent features, and unmentioned damages.
|This misinformation compelled buyers to spend considerable effort and time seeking remedies, with some incurring additional repair costs or selling the cars at a loss.
ACCC Commissioner Liza Carver emphasized the significance of accurate car descriptions, noting the reliance of consumers on vehicles for daily commitments.
She underscored the legal obligation of businesses to ensure the accuracy of their product descriptions to protect consumer rights.
In response to the legal proceedings, Grays has initiated contact with affected customers to offer compensation and has agreed to a court-enforceable undertaking to provide further redress once the court finalizes its orders.
The company has cooperated with the ACCC investigation, contributing to a comprehensive resolution package that includes declarations, penalties, a compliance program, and coverage of legal costs.
Consumers have been cautioned against scammers posing as Grays representatives offering refunds. For legitimate redress inquiries, customers are advised to contact Grays directly.
The Federal Court will schedule a hearing to decide on the proposed orders and penalties.
